6.4 Legal Parameters

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANDHR PROVIDES ALL SERVICES "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
 

7. Responsibility Boundaries
7.1 Liability Scope

ANDHR'S TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF: (1) AMOUNTS PAID TO ANDHR DURING THE TWELVE MONTHS BEFORE YOUR CLAIM AROSE, OR (2) $100 USD.

7.2 Damage Limitations

ANDHR BEARS NO LIABILITY FOR SPECIAL, INCIDENTAL, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES UNDER ANY LEGAL THEORY, INCLUDING DAMAGES RELATED TO LOST PROFITS, DATA LOSS, OR BUSINESS DISRUPTION.
 

8. Access Parameters
8.1 Service Availability

We may suspend or terminate platform access when:

  • Violations harm our community

  • Payment obligations remain unresolved

  • Usage undermines neurodiversity affirmation

  • Legal or security concerns require action

8.2 Post-Termination

Certain obligations continue beyond account termination, particularly regarding intellectual property, payment, liability limitations, and dispute resolution.

9. Data Protection
9.1 Privacy Approach

Our Privacy Policy details information practices designed with awareness that privacy concerns often manifest uniquely for neurodivergent individuals.

9.2 Security Context

We implement reasonable security measures while acknowledging inherent digital communication risks. Your platform usage reflects understanding of these realities.

10. Conflict Resolution

Before formal proceedings, share concerns through your preferred communication channel, allowing 30 days for collaborative resolution.

10.2 Formal Process

Unresolved disputes proceed through binding arbitration administered by the American Arbitration Association in Orlando, Florida, with appropriate accommodations for neurodivergent participants.

10.3 Individual Claims

YOU AGREE TO PURSUE CLAIMS INDIVIDUALLY, WAIVING PARTICIPATION IN CLASS OR COLLECTIVE PROCEEDINGS.

11. Community Guidelines
11.1 Collective Responsibility

Community participation involves commitment to:

  • Respecting sensory and cognitive boundaries

  • Contributing to neuroinclusive practice development

11.2 Content Oversight

12. Legal Structure
12.1 Governing Law

Florida state law governs this agreement without applying conflict of law principles.

12.2 Term Evolution

Terms may change over time. Continued platform usage following change notifications indicates acceptance.

12.3 Severability

Unenforceable provisions remain modified to maximum legal effect while preserving remaining terms intact.

12.4 Enforcement Flexibility

Declining to enforce specific provisions in particular instances preserves our right to enforce those provisions in future situations.

12.5 Assignment Parameters

Your rights require our consent for transfer, while we maintain assignment rights necessary for service continuity.

12.6 Complete Framework

These terms, alongside our Privacy Policy and service-specific agreements, constitute our complete understanding regarding andhr resource usage.
